Terms of Service

1. Agreement to these Terms
These Terms of Service form an agreement between you and Jonathan Hale, operator of TransitSatellite. By accessing or using transitsatellite.com, creating an account or purchasing TransitSatellite Pro, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.
2. The TransitSatellite service
TransitSatellite provides educational and informational tools for exploring satellites, calculated orbital positions, trajectories, visibility estimates, predicted passes and related space content. Features may be added, changed, limited or removed as the service develops.
3. Eligibility and accounts
You must provide accurate information, protect your login credentials and promptly notify us of suspected unauthorized use. You are responsible for activity performed through your account. If you are under the age of legal majority where you live, a parent or legal guardian must approve your use of paid services.
4. Free features and TransitSatellite Pro
Core tracking and educational features may be offered without charge. TransitSatellite Pro provides additional features such as 24-hour trajectory forecasting, timeline controls and forecast playback. Pro features may evolve, and Early Access features may be experimental, changed or later made available more broadly.
5. Subscriptions, renewals and cancellation
Pro is offered as an automatically renewing monthly or yearly subscription at the price displayed during checkout. By subscribing, you authorize Stripe to charge your selected payment method at the beginning of each billing period until canceled.
You may manage or cancel your subscription through the billing portal available from your TransitSatellite account. Unless stated otherwise during cancellation, access continues through the end of the already-paid billing period and the subscription will not renew afterward.
Prices may change in the future. Any change affecting an active subscription will be communicated and applied as required by law. Taxes may be added where applicable.
6. Refunds
Except where required by law or expressly stated otherwise, subscription charges are nonrefundable and partial billing periods are not prorated. If you believe a charge was made in error, contact us promptly so it can be reviewed.
7. Orbital data and prediction limitations
Satellite positions, trajectories and pass predictions are calculated from orbital elements supplied by third-party data sources. They are estimates rather than direct, second-by-second telemetry from each spacecraft. Data can be delayed, incomplete, unavailable or inaccurate, and predictions become less reliable as orbital elements age.
Visibility depends on weather, terrain, buildings, light pollution, satellite brightness, location accuracy and other conditions. A predicted pass does not guarantee that an object will be visible.
Do not use TransitSatellite for navigation, collision avoidance, spacecraft control, emergency response, aviation, maritime operations, national security, life-safety decisions or any other safety-critical or mission-critical purpose.
8. Location features
Location-based results depend on the location and accuracy provided by your device. You control whether to grant location permission. You are responsible for checking local conditions and remaining aware of your surroundings while observing the sky.
9. Affiliate links and gear
Some gear links are Amazon affiliate links. As an Amazon Associate, TransitSatellite earns from qualifying purchases at no additional cost to you. Product information is provided for convenience and may change. Amazon and the applicable seller are responsible for product descriptions, availability, pricing, fulfillment, returns and warranties. A listing is not a guarantee that a product is appropriate for your needs.
10. Acceptable use
You may not:
- Use the service in violation of law or another person's rights.
- Attempt to bypass account, subscription or security controls.
- Interfere with or overload the service or its providers.
- Introduce malware or use automated access that harms the service.
- Misrepresent TransitSatellite data as guaranteed or official telemetry.
- Resell or commercially exploit the service without written permission.
11. Intellectual property
TransitSatellite's original software, design, branding, text and other original content are owned by Jonathan Hale or used with permission and are protected by applicable law. Third-party names, trademarks, imagery and data remain the property of their respective owners. These Terms do not transfer ownership to you.
12. Third-party services
TransitSatellite relies on and may link to third-party services, data sources and websites. We do not control those services and are not responsible for their availability, content, security, policies or actions. Your use of them may be governed by separate terms.
13. Availability and Early Access
The service is provided on an evolving basis and may experience outages, errors or interruptions. Early Access features may be unfinished and may change substantially. We do not promise that every feature will remain available or operate without error.
14. Suspension and termination
We may suspend or terminate access when reasonably necessary to protect the service or others, address fraud or security risks, comply with law, respond to nonpayment or enforce these Terms. You may stop using the service at any time and may request account deletion by contacting us.
15. Disclaimer of warranties
To the fullest extent permitted by law, TransitSatellite is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose and noninfringement. Nothing in these Terms excludes a warranty that cannot legally be excluded.
16. Limitation of liability
To the fullest extent permitted by law, Jonathan Hale and TransitSatellite will not be liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost data, loss of use or damages arising from reliance on orbital or visibility information. To the fullest extent permitted by law, total liability for claims relating to the service will not exceed the amount you paid to TransitSatellite during the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
17. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute that is not otherwise resolved will be brought in a court with proper jurisdiction in Florida, except where applicable consumer law requires otherwise.
18. Changes to these Terms
We may revise these Terms as the service changes. Updated Terms will be posted here with a new “Last updated” date. Continued use after updated Terms take effect means you accept them, except where additional notice or consent is required by law.
